01 · Acceptable Use Policy (AUP)
Legal basis: IT Act, 2000 · IT Intermediary Rules, 2021 (as amended 2025) · Indian Penal Code, 1860 · Bharatiya Nyaya Sanhita, 2023.
Prohibited Activities (Non-Exhaustive)
- Spam, bulk unsolicited email, mail bombing
- Phishing, malware, ransomware, scam sites
- DDoS origination, network flooding, packet flooding
- Port scanning, brute force, credential testing, unauthorised penetration testing
- Botnet command-and-control, carding, hacking archives
- CSAM — immediate suspension, details handed to authorities
- Proxy / VPN / Tor relay without written approval
- Crypto mining without disclosure and approval
- Scraping violating third-party terms
- Any activity violating Indian law or the laws of the Customer's own jurisdiction
- Hosting, transmitting, or sharing non-consensual intimate imagery (NCII) or deepfake content
- Generating or distributing synthetically generated content without required labelling or metadata
Foreign Law Compliance
The Customer is solely responsible for compliance with all laws applicable to its use of the Services, including the laws of the Customer's own jurisdiction. We shall not be liable for any violation of foreign law by the Customer.
Enforcement
Immediate suspension without notice for urgent triggers (phishing, CSAM, DDoS, spam, NCII, deepfake). AUP violations result in immediate termination without notice, wallet balance forfeiture, and potential IP-blocking across all infrastructure. Reporting to CERT-In within 6 hours.
02 · Abuse and Suspension Policy
Legal basis: CERT-In Directions 2022 · IT Intermediary Rules, 2021 (as amended 2025).
- Reporting channel: abuse@adhabidatacentre.in. Urgent matters acknowledged within 4 hours.
- Urgent suspension triggers (no prior notice): Phishing, malware, botnet, DDoS, credential theft, port scanning, spam campaigns, fraudulent sites, CSAM, NCII, deepfake content, court order.
- Customer notification: Where practical, before suspension. For urgent matters, after suspension.
- Evidence preservation: Logs preserved for 180 days.
- Termination: Serious incidents = immediate termination + CERT-In reporting + law-enforcement referral where legally required.
- No liability: We are not liable for customer losses arising from lawful suspension under this policy.
03 · Refund and Cancellation Policy
Legal basis: Indian Contract Act, 1872 · Consumer Protection Act, 2019.
- VPS / Dedicated Servers: Non-refundable once provisioned or activated.
- Shared Hosting: Refund within 7 days only if service is unused and no abuse complaint. Setup fees, domain fees, dedicated IP fees are non-refundable.
- Wallet Deposits: Prepaid wallet deposits are non-refundable and non-transferable to bank accounts once credited, except where mandated by applicable Indian laws or in instances of permanent system failure.
- Failed Provisioning: If provisioning fails permanently due to infrastructure errors, the amount is credited back to the wallet balance only, not to the bank account.
- Cancellation: Written request via client portal only. Minimum 30 days' notice for subscription cancellations.
- Chargeback: Account suspended immediately. Recovery costs plus chargeback fee charged to the customer.
- Verification Failure: Refund issued minus payment gateway charges, at our discretion.
- Abuse Termination: No refund under any circumstances.
